The Human Rights Act - From October 2, 2000, the Human Rights Act comes into full effect. It safeguards 16 basic rights, like the right to liberty, freedom of expression and respect for private and family life. These are all the things we should have been used to in this country, (that is, if you are not gay, or black). But if your rights are ever infringed, it's good to know that there's something you can do about it. December 2005 14 July 2003 - The House of Lords has supported the repeal of Section 28 in England and Wales by a majority of 180 to 130 votes. Section 28 will now be repealed two months after the Local Government Bill comes into law over the summer. Allows foreign partners of gay citizens to receive residency permits. Sexually explicit gay literature cannot be imported. Allows gays in the military. ENGLAND, SCOTLAND, WALES & NORTHERN IRELAND Have no sodomy laws. The age of sexual consent is 16 for gay males, and 16 for heterosexuals and lesbians, except in Northern Ireland, where the heterosexual and lesbian age of sexual consent is 17. Same-sex age of consent offences are treated much more seriously than equivalent heterosexual offences: "for consensual heterosexual intercourse with girls between 13 and 16 the tariff [a band, established by Appeal Court decisions, within which a sentence is supposed to fall] is a fine or a conditional discharge or imprisonment up to 1 year for older offenders. In practice, the male partner is usually given a caution or, if prosecuted at all, no more than a fine. For consensual sexual activity by a man with a boy of corresponding age, however, the tariff, which in this instance the courts tend to follow, is 3 - 5 years imprisonment." Consensual S/M sex is illegal. Sex may only involve 2 people. Sex may only take place in ones home. Scotland's parliament grants travel allowances to the domestic partners of its gay and straight members. Partners are reimbursed for up to 12 journeys a year between their homes and Edinburgh.
The British Virgin Islands, Turks and Caicos Islands, Anguilla, Montserrat and Cayman Islands, all British dependent territories, have sodomy laws. The Turks and Caicos Islands has a sodomy law for males, punishable with up to life imprisonment at the discretion of the judge. The law is silent with regard to the legal status of sexual acts between women. Bermuda, a British dependent territory, has no sodomy laws. Gibraltar, has no sodomy laws, the age of sexual consent is 18 for homosexuals, and 16 for heterosexuals. In the Cayman Islands, Julianna O`Connor-Connolly, Community Affairs Minister, is very anti-gay.
